In this vital role you will be responsible for counseling Amgen’s Global Commercial Operations clients on a wide variety of legal and regulatory issues concerning promotion, sales, patient support programs, contracting, education and scientific exchange regarding biopharmaceutical products that are subject to oversight and regulation by several entities of the U.S. Federal government.The primary responsibilities of this position will include:Advising and counseling on complex commercial transactions on price concession strategies and risk mitigation with members of the healthcare community, with emphasis on the Anti-Kickback Statute and applicable antitrust lawsAnalyzing, reviewing and approving promotional, educational and support programs and materials and providing guidance on proposed sales and marketing strategiesDrafting and negotiating pricing agreements, supply agreements and/or value-based agreements with above mentioned entities to provide for strategic pricing of Amgen productsReviewing and counseling on government enforcement actions relating to the promotion of biopharmaceutical productsAdvising and providing on-going training key partners on legal, regulatory and policy developments to ensure that legal support is adapted to a rapidly changing environmentOverseeing pricing agreement interpretation and contract enforcement, advising and managing commercial dispute resolutionSupporting healthcare compliance related matters as they relate to implementation of pricing agreements and/or sales and marketing activitiesCoordinating legal support by contributing as a member of cross-functional team and interacting with business and law department colleagues on various mattersWhat we expect of youWe are all different, yet we all use our unique contributions to serve patients. The professional we seek is has these qualifications:Basic Qualifications:J.D. degree or LL.M. degree from an accredited law school, admission to practice law in a U.S. jurisdiction and four (4) years of experience practicing lawPreferred Qualifications:6+ years of corporate and/or law firm experience counseling clients on healthcare/life sciences mattersExperience counseling clients on complex legal and regulatory considerations including:Healthcare fraud and abuse mattersFDA promotional regulationsOIG compliance guidance and advisory opinionsDOJ settlements with pharmaceutical industryMedicare/Medicaid reimbursement and contractingProven superior legal skills, including excellent oral and written communication, legal analysis, drafting and negotiation skillsAbility to lead and influence othersStrong client service, business counseling and problem-solving focusAbility to manage multi-dimensional projects in a fast-paced environmentSuperior academic achievementWhat you can expect of usAs we work to develop treatments that take care of others, we also work to care for your professional and personal growth and well-being.
